Kirby Wins Million Dollar Verdict Against Chenango County for Injured Motorcyclst

In one of Chenango County’s largest verdicts, owner/founder Andrew Kirby won a substantial verdict against the County of Chenango. Following a seven day trial, the jury found that the County of Chenango negligently allowed ruts, a known hazardous condition, to exist on County Road 25 near the Chobani plant. Our client instantly lost control of his motorcycle after hitting this dangerous condition, and suffered a severe head injury which rendered him permanently deaf in one ear, fractured his shoulder blade and tore several ligaments in his ankle, which required two surgeries. No comparative fault was assigned to my client by the jury, rendering the County 100% liable for our client’s damages.. The jury awarded our client $1,173,000.00 for his past and future pain and suffering, past lost wages, and past medical expenses.
